The case for a special counsel to investigate Hillary Clinton

America tried to let Hillary Clinton off the hook. Despite cries of “lock her up” during the campaign, most of the nation had little appetite for prosecuting her after the election, with even Donald Trump willing to give her a free pass.
“I don’t want to hurt the Clintons, I really don’t,” Trump told The New York Times two weeks after his victory. “She went through a lot and suffered greatly in many different ways.”
But the Clinton e-mail scandal, like Clinton herself, won’t go away. It remains a blot on the legacy of the Obama administration, the Justice Department and the FBI, and now comes fresh evidence that the investigation that cleared her was a total sham.
The revelation from the Senate Judiciary Committee that J. Edgar Comey drafted his statement exonerating her about two months before FBI agents interviewed Clinton or 16 other witnesses confirms suspicions that the probe was neither honest nor thorough. When the outcome is decided long before the investigation is over, the result can’t be trusted.
Imagine a baseball game where the final score is decided before the players take the field. What’s the point of playing the game, and why should spectators trust anyone involved?
So it is with the FBI probe of Clinton. The new evidence, Trump said in a tweet, is proof of a “rigged system!” There is no better way to describe it.
There is only one possible cure for this kind of rot — a special counsel charged with reopening the Clinton e-mail case and the actions of Comey and Attorney General Loretta Lynch.
Two dozen House Republicans demanded a special counsel in July, and the chorus is certain to grow because of testimony showing Comey made his decision long before the probe ended.
The testimony came from two top officials under Comey when he headed the FBI, one of them his chief of staff, Jim Rybicki. It was made during an internal probe of Comey’s conduct, which was stopped when Trump fired him in May.
Both officials said under oath that Comey circulated the first draft of a statement clearing Clinton in April or May of last year, even though Clinton wasn’t interviewed until July 2. Just three days later, Comey publicly cleared the Democratic nominee of any criminal charges.
“Conclusion first, fact-gathering second — that’s no way to run an investigation,” Republican Sens. Chuck Grassley of Iowa and Lindsey Graham of South Carolina charged in a bombshell letter to the FBI that included excerpts of the previously secret testimony. They demanded the bureau turn over all drafts of Comey’s statement and other documents related to the final decision.
The development is more proof that Comey was not the Boy Scout he pretended to be. As I have written, he learned well the lesson of J. Edgar Hoover that gathering dirt on top officials, including presidents, was the best job security.
But Comey made big mistakes, and the new evidence offers a clear suggestion he lied to Congress on at least one occasion.
Politico reports that, at a House hearing a year ago, while Barack Obama was still president, Comey denied any decision had been made not to charge Clinton before she was interviewed.
“If colleagues of ours believe I am lying about when I made this decision, please urge them to contact me privately so we can have a conversation about this,” Comey testified. “All I can do is tell you again, the decision was made after that because I didn’t know what was going to happen in that interview.”
He could make those assertions secure in the Washington wisdom that Clinton would win the election and the issue of his conduct would never see the light of day. After all, he would have all the dirt on her.
But Trump’s victory changed everything, and by early May, Comey was telling Congress he had lost faith in Attorney General Lynch last year because of her tarmac meeting with Bill Clinton in Phoenix. He had never before raised such concerns.
He changed his tune again after Trump fired him, telling Congress he kept detailed notes of his meetings with Trump because he didn’t trust him. He admitted leaking those notes to the media in hopes it would lead to the appointment of a special counsel to investigate Trump.
He succeeded, and the investigation by Robert Mueller is ongoing, and hardly a day goes by without a leak about who in Trump’s circle has been summoned to a grand jury.
Perhaps conveniently, a new leak emerged Thursday, saying Mueller got copies of a draft letter that reflected Trump’s reasons for firing Comey. Could the timing of the leak have anything to do with the release of the Grassley-Graham letter the same day?
It is a reflection of the peculiarities of last year’s campaign that a special counsel on Clinton would be the ultimate in fair play. Because the FBI investigated both Clinton and Trump during the election, a special counsel for Clinton would perfectly complement Mueller’s probe of Trump. Presumably, an equal number of leaks will be part of the deal.
Think of it as a sequel to 2016. And maybe someday America will learn what it did to deserve an election that refuses to get off the stage.

“Those deductions actually affect the high-bracket payers, so when you actually simplify that tax returns you’re actually affecting the high taxpayers the most.
“As you simplify the tax system, you actually reduce taxes on middle-class income payers and average Americans and you’re actually taxing the higher end at a higher rate.”
Actually — you don’t need to say it.

‘Stringing’ us along
Scott Stringer should have the courage to join the side he’s on.
The Post reports that the city controller has conducted 18 audits of Mayor de Blasio’s education department and found it “an opaque agency that acts as if the rules don’t apply to them.”
Yet still Stringer endorses fellow Democrat de Blasio, illustrating how one-party rule screws taxpayers and children.

Texas chemical plant that forced evacuations after Harvey has questionable safety history

The flooded Texas chemical plant where explosions forced evacuations last week had received 10 serious violations over workplace safety recently, according to a report obtained by Fox News.
The Arkema plant was storing approximately 500,000 pounds of organic peroxide, which is set to ignite or explode over the next couple of days, after three cooling systems damaged by Hurricane Harvey's flooding ignited. The remaining peroxide is being held in trailers -- and on Sunday, the company announced it started a controlled ignition of the other trailers, claiming the process would not pose any additional risk.

Mattis: Any North Korea threats ‘will be met with massive military response’

Defense Secretary James Mattis on Sunday laid out a powerful threat to North Korea after its latest nuclear weapon test, saying the US wasn’t planning for the “total annihilation” of the rogue regime even though it has “many options to do so.”
“All members unanimously agreed on the threat North Korea poses and they remain unanimous in their commitment of a de-nuclearization of the Korean peninsula,” he said. “Because we are not looking to the total annihilation of a country – namely North Korea – but as I said we have many options to do so.”
Mattis’ remarks come after President Trump met with his national security team at the White House.

North Korea made clear its determination this weekend to keep advancing its nuclear weapons program, conducting its sixth and most powerful underground nuclear test only hours after claiming it has now developed a hydrogen bomb that can reach United States with the potential to kill millions.
I doubt the truth of the North’s boast that it has already developed an H-bomb that can be mounted on an intercontinental ballistic missile to wipe out a U.S. city or a city in another nation. But we could see the North achieve this frightening goal soon unless President Trump acts quickly and decisively.

I would argue that North Korea likely can already hit the U.S. with a crude nuclear delivery capability – now. So it’s an urgent matter of national security for President Trump and his administration to act to contain the nuclear and missile capabilities that Kim already has.

Comey and Clinton: Rigged from the beginning

'Exoneration statement' another blow to Comey's credibility?
Newly disclosed evidence that then-FBI Director James Comey began working on a statement to reject criminal charges against former Democratic presidential candidate Hillary Clinton months before she and other key witnesses were interviewed by the FBI shows that President Trump was right to fire Comey.
The evidence proves that Trump and his supporters were correct to say throughout the presidential campaign that Washington operates on a “rigged” crony system that serves the interests of the powerful and rewards corporate globalists to the detriment of the American people.
As evidence of the rigged system, voters sided with Trump during the campaign in often citing Clinton’s apparent immunity from consequences regarding her unsavory acts as secretary of state, especially her hidden emails on a private server, as well as corrupt Clinton Foundation dealings.
Given what we learned in recent days about Comey, the investigation he oversaw of Clinton represented the very worst of the rigged process. Instead of acting as an impartial, honest fact-finder on behalf of the American people, Comey behaved like a partisan hack.
The former FBI director’s reprehensible behavior both during and after his tenure surely validates the judgment of President Trump in firing a man totally unfit to oversee our most revered law enforcement agency in our nation.
The new evidence is revealed in a letter sent Wednesday to FBI Director Christopher Wray from Republican Senators Chuck Grassley of Iowa and Lindsey Graham of South Carolina. The letter is a bombshell, and didn’t get anywhere near the media attention it deserves.
The evidence disclosed by Grassley and Graham comes from the Office of Special Counsel, a government agency that investigated whether Comey violated the law when he was FBI director. The investigation was closed after Comey was fired. The new evidence shows that Comey drafted a memo exonerating Clinton of wrongdoing as early as April 2016, even though Clinton was not interviewed until July 2016.
As Grassley and Graham correctly stated in their letter: “conclusion first, fact-gathering second – that’s no way to run an investigation.”
In fact, after Comey wrote his “nothing to see here” draft absolving Clinton of wrongdoing, the FBI still interviewed a total of 17 key officials. In addition to Clinton herself, State Department Chief of Staff Cheryl Mills, who was appointed by Clinton and served under her, was also questioned. Mills received a very unusual immunity agreement from investigators.
How is it possible that Comey had ascertained, at such an early date, that the evidence would not incriminate Hillary Clinton? Such a prejudicial judgment certainly reveals a shocking level of bias and a dangerous willingness to engage in partisan politics.
Understandably, President Trump reacted to the new evidence with indignation, tweeting Friday: “Comey exonerated Hillary Clinton long before the investigation was over … a rigged system!”
Many Americans had already concluded that Comey’s investigation of Clinton was a sham. The majority in a July 2016 Washington Post/ABC News poll disagreed with Comey’s decision to not seek an indictment against her.
The American people were poorly served by an FBI director who shirked his duty as a public servant. They thankfully delivered their verdict on Clinton’s suitability for the Oval Office at the ballot box last November.
Adding insult to injury, Comey’s deceptive practices extended beyond his FBI tenure. Once he was fired by President Trump, he again showed his true colors by leaking confidential information to the media with the expressed intention of triggering a special counsel investigation
Comey’s pattern of unethical bias, plus his personal ties to Special Counsel Robert Mueller going back many years, seriously tarnish Mueller’s standing.
Donald Trump triumphed in 2016 because he promised to “drain the swamp” in Washington. Sadly, the swamp has proven resilient, from Capitol Hill to James Comey in obstructing the president’s transformational agenda.
In the end, the will of the people must prevail and smash a rigged system that has stolen the dignity and prosperity of Americans.

FBI, DHS warned of increasingly violent Antifa clashes in 2016, documents show

Well before the deadly Aug. 12 rally in Charlottesville and the ongoing violent clashes with white supremacists and other groups, federal authorities warned local officials the actions of left-wing extremists were becoming increasingly confrontational and dangerous.
Federal agencies warned of the growing likelihood of lethal violence between left-wing anarchists and right-wing white supremacists.
Some even classified their activities as “domestic terrorist violence.”
In previously unreported documents dating back to April 2016 and viewed by Fox News, the FBI and Department of Homeland Security wrote that “anarchist extremists” and Antifa groups were the primary instigators of violence at public rallies. They blamed these groups for attacks on police, government and political institutions, racists, fascists and “symbols of capitalism.”
The agencies warned the rise of fascist, nationalist, racist or anti-immigrant groups in U.S. political discourse could lead to violent backlash from these “anarchist extremists.”
The FBI and DHS had no comment on the assessments, saying they were not intended to be made public.
POLITCO was the first to report on the documents Friday.
Brian Levin, a former New York City police officer who monitors domestic militants at the Center for Study of Hate and Extremism at California State University, San Bernardino, cautioned calling all members of the Antifa movement “domestic terrorists,” and said not all tolerate the use of violence while protesting.

Black smoke was seen Friday billowing from the chimney of the Russian consulate in San Francisco on the eve of its ordered closure by the Trump administration.
Firefighters from the San Francisco Fire Department arrived on the scene to investigate reports of smoke coming from the roof of the building but were turned away by consulate officials who said they were burning unidentified items in a fireplace, according to the Associated Press.

The consulate is Russia's oldest in the U.S. and was ordered by the Trump administration to be shut down in retaliation against Russia's recent expulsion of U.S. diplomats from Moscow.
On Friday, Russian state media reported that the Russian foreign ministry has said U.S. security services intend to conduct searches in the San Francisco consulate on Sept. 2.

GOP senators seek more information on Comey and Clinton
A federal judge has ordered the FBI to disclose more details on how the agency handled Hillary Clinton’s secret email account.
U.S. District Judge James E. Boasberg said court papers that describe the grand jury subpoenas the FBI obtained to press for information from Clinton’s internet service providers can be made available to the public, the Washington Times reported.
“After reviewing the document in camera, the court concludes that it largely rehashes information already made public, thus obviating any need for secrecy,” the judge said.
Two groups, Judicial Watch and Cause of Action Institute, have been pressing the government for more information about the Clinton emails, and they say the ruling is a victory for transparency.

Former Bush speechwriter Marc Thiessen ripped Antifa rioters, saying their entire movement is "a lie."
Thiessen said Antifa claims to be "anti-fascist" but is instead markedly fascistic.
He said the woman whose free speech protest they overran in Berkeley, Calif. recently is a transsexual Trump supporter.
He and Professor Jonathan Turley of George Washington University said all extremist groups - Antifa and Neo-Nazis both - should be condemned by all politicians.
"They don't believe that people have a right to speak freely," Turley said.
"Once you start to create this generation of speech-intolerant kids - where are we heading?" he added.
Turley and Thiessen said that by being so intolerant of free speech, they contradict their self-described mission to crush fascism.
