Justice Thomas Raises Scrutiny on Special Counsel Jack Smith’s Appointment in Trump Hearing

U.S. Supreme Court Justice Clarence Thomas has asked former President Donald Trump’s lawyers about whether they challenged special counsel Jack Smith’s authority to bring charges against the president.
On April 25, the U.S. Supreme Court heard oral arguments in a case about President Trump’s being immune from prosecution for official acts carried out during his presidency. During the hearing, Justice Thomas asked John Sauer, the attorney who represented President Trump in court, “Did you, in this litigation, challenge the appointment of special counsel?” Mr. Smith was appointed to the case by Attorney General Merrick Garland.
Mr. Sauer said that Trump attorneys have not raised such concerns “directly” in the current case at the Supreme Court. However, “it points to a very important issue here, because one of [the prosecution’s] arguments is, of course, that we should have this presumption of regularity,” Mr. Sauer stated.
“That runs into the reality that we have here an extraordinary prosecutorial power being exercised by someone who was never nominated by the president or confirmed by the Senate at any time,” he said.
“We hadn’t raised it yet in this case when this case went up on appeal.”
Mr. Sauer said he agrees with the “analysis provided by Attorney General [Edwin] Meese and Attorney General [Michael B.] Mukasey,” referring to the amicus brief the two former attorneys general submitted to the Supreme Court on March 19.
In it, the two attorneys general noted that irrespective of what one thinks about the immunity issue, Mr. Smith “does not have authority to conduct the underlying prosecution.”
“Those actions can be taken only by persons properly appointed as federal officers to properly created federal offices. Smith wields tremendous power, and effectively answers to no one,” they wrote.
“However, neither Smith nor the position of special counsel under which he purportedly acts meets those criteria. And that is a serious problem for the rule of law, whatever one may think of the conduct at issue in Smith’s prosecution.”
Attorney General Garland appointed Mr. Smith as special counsel of the U.S. Department of Justice, citing several statutes.
However, none of these statutes even “remotely authorized the appointment by the Attorney General of a private citizen or government employee to receive extraordinary criminal law enforcement power under the title of Special Counsel.”
The two attorneys general added there are times when the appointment of a special counsel would be appropriate and that the U.S. Constitution allows for such appointments.
However, “the Attorney General cannot appoint someone never confirmed by the Senate, as a substitute United States Attorney under the title ‘special counsel,’” they added.
“Smith’s appointment was thus unlawful, as are all actions flowing from it, including his prosecution of former President Trump,” they wrote.

Creator of the West Wing Blames This Person for January 6...And It's Not Trump

Well, that’s a curveball regarding the drama over January 6. For liberals, it remains burned into their memories. For everyone else, we do not care anymore. Yet, the Justice Department has joined Democrats in arresting and charging hundreds of people for walking around the U.S. Capitol that day. Only one person, Ashli Babbitt, was killed, and it was by a Capitol Police officer. Was it our nation’s proudest moment? No, but it wasn’t worse than the Civil War or Pearl Harbor, and it's been weaponized by Democrats to go after their political enemies. Donald Trump is the number one public enemy, but Aaron Sorkin, creator of The West Wing, has a different culprit in mind: Facebook.
Specifically, Sorkin blames Mark Zuckerberg for allowing insanity to reign on his platform, which he views as the never-ending drug that’s fueled the division in this country for the past decade or so. It’s the algorithm from which all content is disseminated. Sorkin is no fan of Trump, being an outspoken liberal. Still, he trained a lot of fire toward Zuckerberg in a recent podcast, where he was mum on many details but openly said he blamed the tech billionaire for the January 6 riot. This week in Florida, Judge Aileen Cannon unsealed a trove of new documents that Jack Smith fought to keep hidden. And you'll soon find out why. Among the documents unsealed were extensive exhibits, motions, and other filings shedding light on the intricate web of communication between the Biden White House and the National Archives and Records Administration in the lead-up to Trump's indictment.
Investigative journalist Julie Kelly found something interesting in the documents that could change everything. The first things is testimony from an FBI agent who testified that the General Services Association (GSA) had been in possession of Trump's boxes in Virginia before ordering Trump's team to come get them.

"So an entire pallet full of boxes that had been held by GSA somewhere outside of DC is dumped at Mar-a-Lago," Kelly notes. "Apparently these are the boxes that ended up containing papers with 'classified markings.'"
"I will double check indictment but I don't recall this event in the timeline," she added.
So, it appears that the Biden administration may have been responsible for shipping classified information to Trump's Mar-a-Lago home in Florida. This development is significant because Trump has previously blamed the GSA for packing the boxes that contained the classified documents, only to later accuse Trump of essentially stealing them and using that as pretext for sending the FBI to raid his Mar-a-Lago home in August 2022.
"It was a set-up from the get-go," remarked Tom Fitton, the founder of Judicial Watch.

'Coming to a Theatre Near You:' Dershowitz Warns Columbia University Protesters 'Will Become Terrorists'

College campuses and law enforcement continue to clamp down on pro-Hamas protestors who have been harassing Israeli students nationwide for more than a week.
Many of the pro-terrorism demonstrators incite violence and hate toward the Jewish community, resulting in students and faculty members feeling threatened in a place where they should not.
Former Harvard law professor Alan Dershowitz warned that some of the protestors participating in the encampments at Columbia University will “become terrorists.
“It’s coming to a theatre near you,” the professor cautioned.
Dershowitz explained that universities nationwide have been teaching anti-semitism for years, citing an example of two female activists who went from protesting a movement to terrorists after joining the Weather Underground group— a far-left Marxist militant organization known for building underground bombs.
“Among the people in front of Columbia University are people who will become terrorists, who will help Hamas, who will be part of the fifth column. How do I know this? Because I represented many dissenters and protesters during the 1960s and 1970s. And you know what happened to some of them? Some of them turned from advocating terrorism to becoming terrorists,” he continued.

Former Fox News commentator Tucker Carlson will be bringing his voice to upcoming Australian events that promise to cover a range of topics including “threats to truth, democracy and personal freedoms.”
“I’m so excited to come to Australia,” Mr. Carlson said in a video announcement promoting the Australian Freedom Conference in June, which has events scheduled for five dates across Australia’s main centres.
“Australia always seemed like a place that was very much like where we lived, though maybe a little more exotic and interesting,” he added.
The Australian Freedom Conference is the brainchild of Clive Palmer, an Australian businessman, politician, and mining magnate.
Mr. Palmer extolled Mr. Carlson’s virtues when announcing the event schedule this week.
“Tucker has long advocated that news coverage in the West can be wrongly used as a tool of repression and control,” he said.

Former Attorney General Bill Barr said Friday that he would back former President Donald Trump over President Joe Biden in the 2024 election and that he believes the real threat to democracy is not the former president but the progressive movement and its backing by the Biden administration.
Mr. Barr made the remark in an April 26 interview on CNN, in which he was asked to respond to a mocking social media post by President Trump in reaction to the former attorney general’s statement last week on Fox News that he would vote for the Republican candidate, whoever that ends up being.
“I think it’s my duty to pick the person I think would do the least harm to the country,” Mr. Barr said on Fox News’s ‘America’s Newsroom’ program on April 17. “And in my mind, that’s—I will vote the Republican ticket.”
President Trump reacted to Mr. Barr’s remark in an April 25 post, stating that he greatly appreciates his “wholehearted” endorsement, while taking a swipe at his one-time attorney general, who has criticized the former president on numerous occasions, including over his claims of voter fraud.
“Wow! Former A.G. Bill Barr, who let a lot of great people down by not investigating Voter Fraud in our Country, has just Endorsed me for President despite the fact that I called him ‘Weak, Slow Moving, Lethargic, Gutless, and Lazy’ (New York Post!),” President Trump posted on Truth Social. “Based on the fact that I greatly appreciate his wholehearted Endorsement, I am removing the word ‘Lethargic’ from my statement. Thank you Bill.”
Mr. Barr was asked by CNN anchor Kaitlan Collins on April 26 to comment on President Trump’s mocking reaction to his endorsement. The former attorney general made clear it had no effect on his decision to back the Republican nominee.

During Thursday’s deliberations at the U.S. Supreme Court on former President Donald Trump’s immunity claim, Supreme Court Justice Brett Kavanaugh warned that a decision in the case has future implications for whether future presidents are shielded from vicious cycles of malicious prosecution that could effectively end the presidency as we know it.
In the course of two-and-a-half hours of oral arguments on April 25, justices on the Supreme Court appeared skeptical of a ruling by a federal appeals court that rejected President Trump’s claim that he has absolute immunity from criminal charges based on his official acts as president.
President Trump was indicted by special counsel Jack Smith in August 2023 on charges of conspiring to overturn the results of the 2020 election.
Pleading not guilty, the former president has argued that he should receive absolute immunity from criminal prosecution for acts that fell within the scope of his official duties. The exception to this immunity, he has argued, is if Congress impeaches and convicts him on charges.
A federal appeals court rejected that argument, claiming that presidents must face prosecution for alleged criminal wrongdoing.
The question that is now before the Supreme Court is: “Whether and if so to what extent does a former president enjoy presidential immunity from criminal prosecution for conduct alleged to involve official acts during his tenure in office?”

Justice Neil Gorsuch, who said that the court is “writing a rule for the ages,” along with Justice Samuel Alito and Justice Kavanaugh all said that their concern was not so much the case against President Trump, but rather the effect of the ruling on future presidencies.
“This case has huge implications for the presidency, for the future of the presidency, for the future of the country,” Justice Kavanaugh said.

According to a new poll released Friday, President Joe Biden has a record-setting, low popularity rating, worse than the nine presidents who served in the White House before him.
Gallup's job approval rating survey looked at the 13th quarter recorded for each president since 1956, which begins on January 20 and ends on April 19. Biden's job approval rating in his 13th quarter of presidency is considered a historic low at 38.7 percent. It surpasses George H.W. Bush's previous lowest record of a 41.8 percent average job approval rating.
Among presidents elected to their first term since Dwight D. Eisenhower, Biden had the lowest average job approval rating in their thirteenth quarter. Eisenhower, on the other hand, had the highest rating of all these presidents.
The chart provided for RedState readers orders the presidents by 13th quarter popularity ranking, demonstrating that except for Obama, the presidents below a 50 percent approval threshold at this point of their first term were not successfully re-elected to a second term.

The University of Florida is setting strict boundaries for students who participate in pro-terrorism protests as the rise of anti-semitism hits college campuses.
Officials at U of Florida issued a stern warning on Friday to pro-Hamas demonstrators, warning such behavior will not be tolerated or risk facing damaging consequences.
According to a memo obtained by Fox Business, the university spelled out what is acceptable and what is not while still allowing students to express their freedom of speech.
The guidelines permit peaceful protests, including verbal expressions of viewpoints and signs. However, tents, sleeping bags, amplified sound, protests inside campus buildings, threats, and violent behavior will immediately result in expulsion for the student
The university’s warning comes amid aggravated protests who have engaged in threatening behavior toward the Jewish community at schools such as Columbia, Yale, and Harvard.

A judge in Florida went on an unsealing spree this week, making public a trove of documents that had previously been filed under seal or in heavily redacted form in former President Donald Trump’s classified documents case.
The documents, which included hundreds of pages of exhibits, motions, and other filings, underscored the close communication the Biden White House and the National Archives and Records Administration had in the year before Trump was indicted.

Fleitz to Newsmax: China Meddling to Get Biden Reelected

Fred Fleitz, vice chair of the Center for American Security, told Newsmax on Saturday that "China's probably meddling in the 2024 election to get [President Joe] Biden reelected."
On Friday, Secretary of State Antony Blinken told CNN that the White House has found potential evidence of election interference, specifically from China. Following his three-day trip in which he met with high-ranking Chinese officials, Blinken said he had seen "evidence of attempts to influence and arguably interfere" with the upcoming elections in the U.S.
Fleitz felt it was ironic that Blinken was raising the issue of Chinese interference as he assumes the country's goal is to help Biden.
"I think that China's probably meddling in the 2024 election to get Biden reelected. They don't want [former President Donald] Trump back. They know Trump will be a real problem. He'll stand up to them to put more tariffs on China," he said during an appearance on "Wake Up America Weekend."
China expert Gordon Chang joined the discussion and said, "China is trying to destroy the United States because they believe we're an existential threat."

Dick Morris to Newsmax: NYC's Cheers for Trump Bode Well Nationally

The enthusiastic welcome former President Donald Trump received this week with his visits to a bodega and a construction site during his time away from his Manhattan trial is a sign that his popularity is huge not only in New York City, but "well beyond," political strategist Dick Morris, an adviser to the presumptive GOP nominee, said on Newsmax Saturday.
"The Sienna College-New York Times poll showed him only about 10 points behind in New York, so he conceivably could be in play there," Morris told Newsmax's "Saturday Report."
Meanwhile, Morris debunked concerns that a play by President Joe Biden for the states of Michigan and Wisconsin, given higher numbers of pro-Palestinian voters, could give Trump trouble.
"There is no Palestinian base in the American electorate," Morris said. "Michigan is 2.5% or 3% of the vote, and that's it, and Wisconsin even less."
However, Biden's push for those states "relates to the general ethos of the radical left that opposes Israel is basically antisemitic and sympathizes with the Palestinians on the grounds that they are anti-colonial," said Morris.
And the push is "just an effort to avoid a rupture within the Democratic Party," said Morris.
Meanwhile, keeping Trump tied up in court is "backfiring" on Democrats.

Former CIA Director and retired U.S. Army Gen. David Petraeus told Newsmax on Friday that the U.S. and Israel will never let Iran have a nuclear bomb, even though the Islamic regime is close to developing weapons-grade uranium.
Rafael Mariano Grossi, the head of the International Atomic Energy Agency, said earlier this week that Iran is weeks rather than months away from possessing enough enriched uranium to build a nuclear bomb. Iran reportedly has uranium enriched at 60% and needs it to reach 90% to be weapons-grade.
"What the head of the IAEA is saying is that it would only take a few weeks for them to go from the current stage of enrichment, which is about 60%, to weapons-grade, which is roughly 90%," Petraeus told "The Record With Greta Van Susteren." "That, I think, is absolutely correct. And they have enough of the 60% that they could produce enough weapons-grade for a bomb.

The Department of Justice (DOJ) stands its ground on its refusal to surrender the audio recording of Special Counsel Robert Hur’s interview with President Joe Biden to the House Oversight Committee.
Reps. Jim Jordan (R-Ohio) and James Comer (R-Ky.), chairmen of the House Judiciary and Oversight Accountability committees, warned Attorney General Merrick Garland that he would hold him in contempt of Congress unless he handed over the recording of Mr. Hur’s interview stemming from a probe into President Biden’s alleged mishandling of classified information.
In the letter, signed on April 25, Assistant Attorney General Carlos Felipe Uriarte told Mr. Jordan and Mr. Comer that despite the committees’ threats of contempt proceedings, the DOJ has adequately responded and sees no reason to give the audio to the committees.
“We have repeatedly invited the Committees to identify how these audio recordings from law enforcement files would serve the purposes for which you say you want them,” the letter stated. “We have also repeatedly urged the Committees to avoid unnecessary conflict and to respect the public interest in the Department’s ability to conduct effective investigations by protecting sensitive law enforcement files.”
Mr. Uriarte said the DOJ has already complied with the committees’ request by providing Mr. Hur’s report and testimony in addition to transcripts of the interview.
“This is consistent with our strong record of cooperation this Congress,” Mr. Uriarte said.

George Washington University law professor Jonathan Turley on Friday said the prosecution’s case against former President Donald Trump is failing as a key witness is benefiting the defense.
Trump is on trial facing 34 felony counts of allegedly falsifying business records in relation to a $130,000 payment to porn star Stormy Daniels ahead of the 2016 election. The prosecution’s first witness, former National Enquirer publisher David Pecker, was helpful to Trump as the prosecution made mistakes that the defense capitalized on during cross-examination, Turley asserted on Fox News’ “Outnumbered.” (RELATED: Turley Says SCOTUS Could Throw ‘Wrench’ Into Jack Smith’s Case Against Trump)
“It’s a breakdown in the courtroom. They have a witness that is disassembling in front of them,” Turley said. “The prosecution never revealed to the jury in the direct that Pecker had actually killed stories for other celebrities, that he had been working on stories two decades before the election with Trump that he was suppressing. And now it’s only getting worse. Yesterday was really bad In terms of the cross-examination for the prosecution. Today is much worse. I mean, here Pecker is saying that Trump didn’t want to purchase the story. Yesterday when he asked him about reimbursing Cohen, he said he didn’t know anything about that.”
Pecker has testified about former Trump attorney Michael Cohen and the former president allegedly purchasing former playboy model Karen McDougal’s story of an alleged affair from the outlet, one of three instances the prosecution argues reveal an unlawful “conspiracy” to influence the 2016 election. In the last days of East Germany, when government officials detected that their power was unraveling, they ratcheted up enforcement of the nation’s reporting laws. These laws made it a felony to know of a crime and fail to report it. It was also a crime to tell the person of whose crime you learned that you had done so. There was no right to privacy and no freedom of speech.
This Orwellian tangle resulted, of course, in many false reports of crimes. It also resulted in many prosecutions for failing to report crimes or warning others that they were being spied upon. As of this past weekend, we are headed to the same authoritarian place. Thanks to legislation that fell one vote short of demise in each house of Congress last weekend, the United States in 2024 will soon resemble East Germany in the late 1980s, where nearly everyone was a spy and no one could talk about it.
Here is the backstory.
The quintessential American right is the right to be left alone. Justice Louis Brandeis called it the most comprehensive of rights and the right most valued by civilized people. It presumes that you can think as you wish, say what you think, read what you want, and publish what you say, that you can exclude whomever you wish — including the government — from your property and from your thoughts, and that you can do all this without a government permission slip or fear of government reprisal.
This natural right is also protected in the Fourth Amendment to the Constitution, which requires a warrant issued by a judge based upon probable cause of crime before the government can invade your property or spy on you.
The warrant requirement serves three purposes.

Stephen Miller to Newsmax: A Supreme Form of Election Interference

The president for America First Legal Stephen Miller told Newsmax on Friday that the four criminal indictments against former President Donald Trump amount to "the most supreme form of election interference."
Trump is facing a total four separate indictments for business fraud, unlawful retention of classified documents, and two cases of election interference. Opening arguments for the business transaction case began this week in Manhattan.
Miller pointed out that because of Trump's various legal entanglements he has been kept off the campaign trail.
"When he's in that courtroom, he is not fundraising, he's not stumping for House candidates to keep the House, he's not stumping for Senate candidates to retake the Senate for the GOP," he said during an appearance on "The Chris Salcedo Show."
The former senior adviser for Trump added, "Every single person involved in this persecution in New York is every day engaged in a conspiracy to subvert the election process in the United States, which is an unsanctioned criminal activity."
"There is no crime that has been committed here other than the crime of the persecutors," Miller said.

Trump Responds to Bill Barr's Endorsement in Typical Fashion

Former President Donald Trump recently picked up an endorsement from his former attorney general, Bill Barr, who turned into a massive critic of the 45th president since leaving the Department of Justice.
As Matt reported, even though he soured on his former boss, Barr still has the sense to realize that President Biden is the greater threat to the nation.
While he recently told Fox News’s Neil Cavuto he’s not happy with the choice between Biden and Trump, he said it’s his “duty” to select the candidate who will “do the least harm to the country.”
To him, that’s Trump and a Republican administration.
“The Biden administration is in fact the greater threat to democracy,” he added. “They have a totalitarian temper. They have bought into the progressive movement. And they’re trying to squelch opposition and freedom of speech.”

Bill Barr, who let a lot of great people down by not investigating Voter Fraud in our Country, has just Endorsed me for President despite the fact that I called him ‘Weak, Slow Moving, Lethargic, Gutless, and Lazy’ (New York Post!),” Trump wrote on Truth Social. “Based on the fact that I greatly appreciate his wholehearted Endorsement, I am removing the word ‘Lethargic’ from my statement. Thank you Bill.”

Supreme Court Signals It Could Hand Trump Partial Win In Immunity Case As Biden DOJ Gets Grilled

Supreme Court justices on Thursday appeared to signal they may hand former President Donald Trump a partial victory in his presidential immunity case by sending it back to a lower court.
Trump’s attorney Dean John Sauer argued that presidents should have constitutional immunity from prosecution for official acts conducted during their presidency. Chief Justice John Roberts, as well as justices Neil Gorsuch and Brett Kavanaugh, brought up the potential for the Supreme Court to send the case back to the United States Court of Appeals for the District of Columbia , which could delay a trial on Trump’s election interference case until at least after the election, according to Politico. President Joe Biden is underwater on nearly every issue that is important to American voters this election season. But the one issue that is becoming even more important than his dismal economy is illegal immigration. Americans are well aware that Joe Biden flinging the U.S. southern border wide open to millions of illegal immigrants from literally all over the world is a mammoth national security issue. Trump has promised that if reelected, he would begin mass deportations of the millions of illegal immigrants that have crossed the southern border, and a new poll shows that a majority of Americans might be on board with those plans.

Imagine my surprise when I discovered I agreed 100 percent with this statement in the New York Times.
Not that I think the Manhattan District Attorney Alvin Bragg is going to lose this case against former President Trump. In fact, I believe that thanks to the ridiculous partisanship and left-wing propaganda that has brainwashed the New York jury pool, and because of the ridiculous bias of the presiding judge in the case, Donald Trump is likely to be convicted in this case, on whatever the imaginary crime is that he is actually being accused of.
But sometimes, a person can win the battle while actually losing the war. And that is what Joe Biden, Alvin Bragg, and their allies are currently in the process of doing.
When even the New York Times has an op-ed by a liberal law professor in good standing that the Bragg case is a joke, you can be sure that the real swing voters for this upcoming election will dismiss any conviction here as obvious partisan lawfare. And every day that this partisan farce continues, the left-wing mainstream media, which heartily believes its own propaganda that Donald Trump is some demonic, undemocratic, corrupt person, will continue to play it up, apparently in coordination with each other to develop anti-Trump talking points. This will allow Trump and his allies to legitimately campaign against the partisan lawfare by the Biden administration. After all, the opening statement in the prosecution’s case was made by the former third ranking Biden Department of Justice lawyer, who transferred to being a lowly line prosecutor in the Manhattan DA’s Office. That is unprecedented; and it is not a good picture for Bragg.
