President Barack Obama cares deeply about his legacy. So will he dare pardon Hillary Clinton? Before there´s any more talk of carving out a chunk of Mt. Rushmore for him, or more talk of statues or temples in his name, there is that Hillary Clinton pardon issue. Would Obama give his former secretary of state a preemptory get-out-of-jail card before he leaves office and turns the White House over to Donald Trump? And if he does pardon Clinton, what of all the promises he and his operatives made to the nation, that he would "transcend" the cynical, broken politics of

The pardons would have to go to her criminal cohort at State, at the Foundation(s), and to that consulting firm. There could be three dozen people involved, if not more.
That would be messy for Barack. Even a person as intellectually challenged as he, should be able to understand that.
But if he goes the pardon route, he had better include himself on the list.

The President has the power to not only pardon someone - that would be in a post conviction setting, usually, but also to issue amnesties for offenses as yet to be prosecuted or even indicted. This is what President Ford did, not only for Nixon, but also for the thousands of American draft dodgers who had avoided service during the Vietnam war. President George Washington was the first to exercise his amnesty power by excusing the participants in Shay´s Rebellion (the Whisky Rebellion). Obama is very likely to pardon Hillary Clinton for her perceived offenses regarding the e-mails. However, the pardon has to be specific to the expected indictment. For example, he can pardon (give protection from prosecution) for her e-mails, but, if he misses pardoning her for lying to congress under oath or to a court, that is committing perjury, she could still be indicted for the perjury. He can not issue blanket amnesty for offenses committed over time, but only for specific perceived offenses. As an example, what if she had committed fraud after her term as SOC? If Obama pardons her for crimes committed specific to her term as SOC, the next Administration can still indict her for the fraud offense.
Also, a pardon or amnesty can not be refused. A pardon carries a certain taint of accused wrong doing- you must have done something to gain a pardon. Once it is issued it a lifetime scar on one´s reputation, even though the person receiving the pardon is restored to full and free citizenship as if the offense never happened. Their reputation is forever marked down.
