Justice Thomas’s argument rested on a premise that has long defined his jurisprudence: America is not just a political arrangement. It is a moral proposition. The Declaration’s claim that all men are created equal and endowed with unalienable rights is not a historical curiosity. It is, in his view, a statement of enduring truth—one that demands not just agreement, but commitment.
