Boehner warns Obama Libya war may violate US law

– President Barack Obama's top critic in the US Congress warned him Tuesday that US operations in the Libya conflict risked violating US law by this weekend unless he gets lawmakers' explicit approval.

Republican US House Speaker John Boehner warned Obama that the administration may fall afoul, come Sunday, of a 90-day deadline set by the 1973 War Powers Act aimed at curtailing US presidents' ability to deploy the military overseas.

"It would appear that in five days, the Administration will be in violation of the War Powers Resolution unless it asks for and receives authorization from Congress or withdraws all US troops and resources from the mission," he said.

In a letter made public by his office, Boehner also gave Obama until Friday to share his legal justification for not seeking explicit congressional approval for a conflict that polls find overwhelmingly unpopular with the US public.

"Given the gravity of the constitutional and statutory questions involved, I request your answer by Friday, June 17," Boehner said in his latest challenge to Obama on his handling of a conflict deeply unpopular with the US public.

The White House issued a statement hours later saying it would soon report to Congress on Libya.

"We are in the final stages of preparing extensive information for the House and Senate that will address a whole host of issues about our ongoing efforts in Libya, including those raised in the House resolution as well as our legal analysis with regard to the War Powers Resolution," said National Security Council spokesman Tommy Vietor.

Boehner, the third-highest ranking US elected official, noted that the White House has simultaneously shrugged off seeking a formal authorization for the conflict and said the US role does not violate the War Powers Act.

"The combination of these actions has left many Members of Congress, as well as the American people, frustrated by the lack of clarity over the Administration's strategic policies" as well as "a refusal" to respect the Congress's role or follow the 1973 law, said Boehner.

The War Powers Act allows the president to use force in response to an attack on the United States, its territories, or its armed forces, but calls for notifying congress within 48 hours and says US troops must start to withdraw 60-90 days later unless specifically authorized to remain by lawmakers.

The US Constitution reserves to congress the right to declare war, though US presidents have often deployed forces without first getting lawmakers' explicit say-so and ignored the war powers measure.

Boehner underlined that Obama's oath of office includes pledges to uphold the US Constitution and US laws -- including the 1973 legislation.

"The House is left to conclude that you have made one of two determinations: either you have concluded the War Powers Resolution does not apply to the mission in Libya, or you have determined the War Powers Resolution is contrary to the Constitution," said Boehner.

"The House, and the American people whom we represent, deserve to know the determination you have made," said the speaker.

Some of Boehner's criticisms echoed complaints from supporters of efforts to oust Libyan strongman Moamer Kadhafi that Obama has not done enough to convince the US public that the mission is important.

The speaker urged the president to "use your unique authority as our president to engage the American people regarding our mission in Libya."

"The ongoing, deeply divisive debate originated with a lack of genuine consultation prior to commencement of operations and has been further exacerbated by the lack of visibility and leadership from you and your Administration," said Boehner.

Was Boehner upset when Bush agreed to pay Libya reparations for the air strikes ordered by Reagan? Obama went into Pakistan to get Bin Laden. Is Boehner upset about that, too?

Presidents of both parties have done the same.... such as Gerald Ford in 1975, at the time of the Mayaguez operation; Jimmy Carter in 1980 with the Desert One hostage rescue attempt; Ronald Reagan in 1983 with the intervention in Grenada and in 1986 with the air attack on Libya; and George Bush with the 1989 invasion of Panama.

Why wasn't Boehner upset about Panama?

It was wrong and illegal to begin with, violating the U.S. Constitution's law that Congress has the only authority to declare war or send service personnel into warfare. The War Powers Act is to deal with such violations of that when somehow the administration uses the excuse of there being an emergency relating to national security. In Libya there was no such emergency. Congratulations to all of the Congresspersons who have enough freedom and critical thinking skills to oppose the destruction of Libya. They are keeping with the spirit and wisdom of those who helped write our United States Constitution. When you vote look at their voting records on Libya.

Boehner's about 10 years too late. The President probably exceeded his authority in the raid on Pakistan also, so maybe the congress should begin impeachment procedures for that.
I guess it's easy being a politician, just attack whatever good thing the opposition does. The party of no.

Obama goes on a bombing run in Libya which is a known terrorist haven run buy a dictator, kills Osama Bin Laden, pulls troops out of Iraq and he should be impeached. Irony of ironies. Now if everyone got jobs he would be labelled a terrorist.Reply.

If you want my advice john i'll give it to you I think you should grow up and accept the fact that taxas are never going away no matter what foxnews says.
