Trump signs orders targeting cashless bail policies in D.C., other states

President Trump signed an executive order Monday threatening to pull federal support from the District of Columbia and other jurisdictions that refuse to ditch their cashless bail policies.
The executive order targeted at the District said federal funds, services or approvals can all be withheld if local leaders don’t comply.
For states and cities with cashless bail policies, such as Illinois, the White House said federal grants and contracts can be canceled if they do not acknowledge the order.
Mr. Trump said in the Oval Office that the move toward cashless bail “was when the big crime in this country started.”
“Somebody kills somebody, they go and [say,] ‘Don’t worry about it. Come back in a couple of months, we’ll give you a trial.’ You never see the person again. And I mean, they kill people and they get out [with] cashless bail,” the president said.
The D.C.-based order tasks Attorney General Pam Bondi with reviewing the District’s current bail policies to see if defendants charged with murder, rape, carjacking, assault, burglary, looting or vandalism are eligible for pretrial release.
The District broadly eliminated cashless bail in the early 1990s and has since relied on judges to determine whether a defendant is a public safety or flight risk who should be kept behind bars while their case plays out. However, a fact sheet from the White House calls into question the soundness of some of those judges’ decisions.
The administration cited the case against Gerald Andre Thomas, who was charged with killing one person and wounding four others while shooting up a D.C. motel room in January 2022. A D.C. Superior Court judge allowed Mr. Thomas, who was 18 at the time, to be let out of jail three months later.
