Supreme Court rejects special counsel’s request to decide Trump’s immunity claim

The Supreme Court on Friday denied special counsel Jack Smith’s request to fast-track a hearing on former President Donald Trump’s claim of immunity from criminal prosecution.
The issue will now remain in the hands of the D.C. Circuit Court of Appeals, which is scheduled to hear arguments on the immunity question on Jan. 9. It’s still possible the high court will have to weigh in on the matter — but not in the expedited way Mr. Smith had hoped would speed up the trial before the November presidential election.
At issue is Mr. Trump’s claim that presidential immunity shields him from prosecution for his actions while president.
Mr. Trump made the immunity claim against charges of conspiracy to defraud the United States, conspiracy to obstruct an official proceeding, obstruction of an official proceeding, and conspiracy against the right to vote. The charges stem from his efforts to overturn the 2020 election results and the pro-Trump mob’s attack on the Capitol on Jan. 6.
