Libya: Saif al-Islam Gaddafi 'could be put on trial in two months'

Saif al-Islam Gaddafi, the son of the former Libyan dictator, could be put on trial in as little as two months, the justice minister has told The Daily Telegraph.

The man once considered heir apparent and a reformist voice in the country is due to be interrogated by a committee established by the attorney-general's office within the next few days.

Mohammed Alagy, the interim justice minister since the establishment of the National Transitional Council, said that the process of putting him on trial in Libya, which has been approved by the International Criminal Court, might be faster than the outside world expected.

"The investigation, run under the proper judicial system, will last a couple of months," he said. "And then he will be put on trial. We are ready."

Mr Alagy was speaking after meeting Luis Moreno-Ocampo, the chief prosecutor of the International Criminal Court, who has agreed that Saif al-Islam's trial will be held in Libya.

Mr Moreno-Ocampo told a press conference yesterday that the main condition would be that he would "not be shielded from justice". He said that he had sought no guarantees that the death sentence would not be imposed.

"A murder is a murder in any country," he said. "He can be tried in Libya under Libyan law."

Mr Alagy said that articles of Libyan law included the death penalty.

"No one can ask for such a guarantee," he said. "No one can order us not to apply articles of Libyan law."

Saif al-Islam is currently being held in the town of Zintan, 100 miles south of Tripoli, whose brigades tracked him down and seized him near the town of Obari in the southern Libyan Sahara on Saturday.

Osama Jueili, the brigade chief appointed defence minister in the new Libyan government, said he was being held on his own and was not allowed to see the four companions with whom he was arrested.

He said he had no access to television or books. "He has not asked for books or anything," he said. "For sure, he is just sitting there just thinking about his fate."

He said he had also refused to meet journalists. "He doesn't want them to see him in a situation like this," he said.

Mr Jueili also said officials were considering how best to conduct an operation, said by doctors to be a matter of urgency, on his wounded fingers.

If he is tried under Libyan law, that also rules out the possibility of international judges joining the panel, an aide to Mr Moreno-Ocampo said.

"ICC judges will only sit if they are applying ICC procedures," Jennifer Schense said.

In an embarrassment for the new authorities, it is becoming clear that Col Gaddafi's right-hand man, Abdullah Senussi, who like Saif al-Islam is wanted by the ICC on war crimes charges, has not been caught. The Fazzan Brigade, based in the southern city of Sabha, said they had caught him in his sister's house nearby on Sunday.

But they have failed to provide photographs or other confirmation to the central authorities. Mr Moreno-Ocampo said he believed he had not been caught.

As part of his investigations, Mr Moreno-Ocampo visited the site of the most notorious war crime of the uprising, the massacre of more than 100 prisoners in a shed in southern Tripoli by members of the brigade led by another son of Col Gaddafi, Khamis.

The shed was set on fire as the brigade fled south from the advancing rebels, and Mr Moreno-Ocampo was taken to see the remaining charred skeletons, which have been left in place as forensic analyses are completed.

The new authorities will have to counter continuing allegations of human rights abuses, including a report released by the United Nations in the name of secretary general Ban Ki-moon.

It said 7,000 people, many foreigners, were being held in revolutionary detention centres without access to courts or a “functioning police and judiciary”. Some had allegedly been tortured.

In view of the recent UN report of atrocities that are being committed by the NTC 's fractions and gangs ,over 7,000 people including many women and children are in jails without trials, being held.

It is quite amazing that the UN and amnesty International are not jumping up and down like effectual jacking in the boxes , trying to get Saif extradited out of the country.

But what have they decideD to do ? is to try to fool the world this will be a fair trial and actually be part of the firing squad.

They are going to sacrifice a man's life rather than say to the NTC look you do not have good record on human rights and your are the last people , to try this person ! .

How sick can the UN and the ICC get , we have just seen the amazing twisting and bending , bungee jumping 1973 UN resolution, now we are going to have double standards on a trampoline !

There is no way he can have a fair trial the UN is just being part of rubber stamping , legalised murder .

Should Saif by executed by the NTC , it will deepen the rift and the divide between the western and eastern tribes ,it will also be travesty of justice .

It will be a further nail in the coffin of the UN , which already has so many nails and so many issues to account for over Libya, now they want to add one more ?

Does the UN have a death wish ?
