EXCLUSIVE: J.D. Vance Rips Special Counsel Jack Smith’s Data Collection Warrant

Ohio Republican Sen. J.D. Vance sent a letter Thursday to Attorney General Merrick Garland regarding a warrant obtained by Special Counsel Jack Smith to prosecute former President Donald Trump.
The Daily Caller first obtained a copy of the letter, which Vance says Smith’s data collection warrant that gave the Special Counsel access to Trump’s Twitter account violates the fourth amendment and calls for Garland to immediately repudiate the search warrant.
“It is hard overstate the breadth of the warrant that Jack Smith obtained. The warrant application’s description of ‘Particular Things to be Seized,’ which was ultimately incorporated by reference into the warrant itself, is in no way particularized,” Vance wrote in the letter.
“Under the Fourth Amendment, a valid warrant must ‘limit the authorization to search to the specific areas and things for which there is probable cause,’ ensuring that ‘the search will be carefully tailored to its justifications, and will not take on the character of the wide-ranging exploratory searches the Framers intended to prohibit.’ Although any ‘justifications’ offered in Smith’s warrant application remain under seal, it is frankly impossible to believe that Smith had probable cause justifying a seizure of ‘all tweets that include the username associated with’ President Trump’s Twitter account, including ‘mentions’ of and ‘replies’ to those tweets,” Vance continued.
